JADE Wellness Center provides complete drug and alcohol program testing and employee evaluation services for employers and employees who are required to adhere to DOT alcohol and drug regulations. These regulations apply to those employees who perform transportation-related safety sensitive functions and the employers who employ them.

JADE Wellness provides the following DOT-mandated services:

The Federal Motor Carrier Safety Administration’s alcohol and drug testing rules apply to every person and to all employers of such employees who operate a commercial motor vehicle in commerce in any state, and is subject to (1) the commercial driver’s license requirements of 49CFR Part 383 or (2) the commercial driver’s license requirements of the Canadian National Safety Code.

The regulations require testing for the following classes of substances:

  • Marijuana
  • Cocaine
  • Opiates
  • Amphetamines
  • Phencyclidine - PCP

The following tests apply to all persons who are required to have a Commercial Drivers License (CDL), for the type vehicle being operated and are provided by JADE Wellness Center’s DOT division on or off site:

Pre-Employment: This test is required and negative results must be received before a motor carrier allows a driver to perform a safety sensitive function. The pre-employment test is only required for controlled substances. Alcohol testing is permitted.

Reasonable Suspicion: This test is required when a trained supervisor/employer has reasonable suspicion to believe that the driver has used alcohol and/or controlled substances.

Random: This unannounced testing is based on a random selection of drivers. The selection must be made by a scientifically valid method and all drivers covered by this rule must have an equal chance of being tested. The names of drivers who are selected for testing must be dept confidential until such time that the carrier notifies the driver to take the test. Once the driver is notified, he/she must immediately proceed to the testing facility and undergo testing. Every driver’s name that is selected for testing must be returned to the selection pool so that all drivers have an equal chance of being selected at any time.

Random alcohol testing is also required by the DOT. However, random alcohol tests can only be administered just prior to a driver performing a safety-sensitive function, while performing a safety[sensitive function or just after performing a safety-sensitive function.

Random controlled substances tests can be conducted at any time the driver is notified.

A driver who is selected and refuses to submit to a test must follow the requirements of 49CFR Part 40, Subpart 0.

Post Accident: This test applies to all CDL drivers who are involved in fatal crashes. The test must also be conducted on all CDL drivers who are cited for moving violations arising in a crash that requires a vehicle to be towed or an injury requiring medical attention away from the scene. The alcohol test must be conducted within 8 hours and the controlled substances test must be conducted within 32 hours of the crash.

The official testing procedures are based on those established by the Department of Health and Human Services. These procedures include: urine sample collection, laboratory procedures and reporting and recordkeeping of final results. Only laboratories certified by Health and Human Services under the National laboratory Certification Program (NLCP) may be used. These procedures exist to safeguard accuracy and to protect the privacy of drivers.

Positive Testing: A driver who has tested positive for any of the substances will be notified and they discuss the positive test results with a qualified Medical Review Officer (MRO) before a result is reported to the employer. The driver will have an opportunity to explain any special circumstances to the MRO. The MRO has the authority and responsibility for reporting the results to the carrier’s alcohol and drug program management for action.

A driver who has violated DOT alcohol and drug regulations is prohibited from performing DOT safety-sensitive duties for any motor carrier until he/she completes the Substance Abuse Professional (SAP) evaluation, referral and education/treatment process set forth in 49 CFR Part 40 Subpart O, and in applicable Federal Motor Carrier Safety Administration (FMCSA) regulations.

ADDITIONAL SERVICES OFFERED

SAP: Substance Abuse Professional (SAP):

A Substance Abuse Professional (SAP) evaluates workers who have violated a DOT drug and alcohol program regulation and makes recommendations concerning education, treatment, follow-up testing and aftercare. Jade Wellness Center offers access to Substance Abuse Professionals who are trained in issues relating to getting workers back to work while complying with the Department of Transportation.

MRO

JADE Wellness Center’s MRO services are provided by a licensed physician with knowledge and experience in treating substance abuse disorders and who has met the DOT training and qualification requirements to perform MRO duties.

The MRO plays a key role in maintaining a fair and accurate drug-testing program. According to DOT, the MRO serves as an objective “gatekeeper and advocate for the accuracy and integrity” of the program. It is important to understand that there is no doctor-patient relationship established by the MRO acting under the Federal regulations. The MRO’s role is to determine whether there are legitimate medical reasons for non-negative specimens.

JADE’s MRO can handle the DOT-mandated review requirements for negative and non-negative specimens. Non-negative results will first be confirmed by a DOT-certified laboratory and then reviewed by the MRO. The MRO will interview the employee as part of the verification process.

Our trained professionals setup screening at client locations making the process efficient and convenient for employees and employers.

Training- Employee and Supervisor Training:

Jade Wellness provides clients with the perfect solution to the Department of Transportation requirements to train all supervisors on Reasonable Suspicion Testing and how to recognize substance abuse. We provide client training to all regulated and non-regulated supervisors.

Computerized Random Selection

What’s the best tool employers have for deterring drug and alcohol use in the workplace? Random Testing and here’s a few reasons why:

Jade Wellness Center generates random drug and alcohol test selections and notifications for employers. Employees are selected through a computerized random number generator on a monthly basis. An employer may elect to have their employees placed in an individual pool or in a larger multi-employer pool with other clients.

Department of Transportation employees are kept in separate pools according to the Federal Motor Carriers Safety Association. Non-mandated employees who require random testing will also be maintained in a pool separate from DOT covered employees
